Axis-One, Inc. is the sole owner of the information collected on this site.  We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.  Axis-One, Inc. collects information from our users at several different points on our website. 

NOTICE OF PRIVACY PRACTICES

This Notice describes how information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

As a client of Axis-One, Inc., you are entitled to receive notice about our privacy practices and how we may use and disclose your personal health information in different circumstances. This Notice explains how we may use and disclose your personal health information, the choices and rights you have about how your personal health information may be used and disclosed, and our obligations to protect the privacy of your personal health information.

Axis-One, Inc. is a company that helps people adopt beneficial change through psychotherapy and various other means of treating mental disorders. 

Introduction. When you become a client of Axis-One, Inc. you provide us with information about your health. Each time you visit us, another record of your visit and what was done is made. Your health record is the information that we use to plan your care, provide treatment and receive payment for our services. It is important for you to understand that your health record contains personal health information that is protected by federal and state laws.

Our Responsibilities. Axis-One, Inc. is required to maintain the privacy of your personal health information and to provide you with a notice about our legal duties and privacy practices with respect to your personal health information. We are also required to accommodate reasonable requests that you make to communicate personal health information by alternative means or at alternative locations. Any time we use or disclose your personal health information, we must follow the terms of this Notice.

How We Use And Disclose Your Protected Health Information.

I. Uses and Disclosures for Treatment, Payment and Health Care Operations. After making a good faith effort to provide you with this Notice, we may use your personal health information to provide your treatment, to obtain payment for your treatment and for our internal health care operations. We may use and disclose your personal health information for such purposes in the following ways:

  1. For Treatment. We may use and disclose your personal health information to plan, provide and coordinate your health care services. For example, we may confer with your primary physician about medical treatment or medications, or may consult with other mental health providers.
  2. For Payment. We may use and disclose your personal health information to obtain payment for health care services we have provided to you. For example, we may contact your insurance company, and give them data from your health information in order for them to pay for the services we offer.
  3. For Health Care Operations. We may use or disclose your protected health information for our health care operations. For example, we may use or disclose your personal health information to perform risk assessments and other administrative tasks to monitor the quality of care that we provide.

II. Uses and Disclosures With Authorization. For uses and disclosures of your personal health information not involving treatment, payment or health care operations, we will receive your written authorization prior to using or disclosing any personal health information (unless we are required or permitted by law to use or disclose your information as set forth below). You have the right to revoke any authorization previously granted. III. Uses and Disclosures Without Authorization. We may use and disclose your personal health information without obtaining your consent or authorization, in the following situations:

  1. Business Associates. There are some services that we provide through contracts with our business associates. In such situations, we may disclose your personal health information to our business associates so they can perform the job we asked them to do. We require all business associates to appropriately safeguard your information, in accordance with applicable law.
  2. Notification of Family or Close Friends. We may use or disclose your personal health information to notify a family member, personal representative or another person responsible for your care, provided you have the opportunity to agree or object to the disclosure. If you are unable to agree or object, we may disclose this information as necessary if we determine that it is in your best interest based upon our professional judgment. In all cases, we will only disclose the health information that is directly relevant to that person’s involvement with your health care.
  3. Required by Law. We may use or disclose your personal health information to the extent that we are required by law to do so. The use or disclosure will be made in full compliance with the applicable law governing the disclosure.
  4. Public Health Activities. We may disclose your personal health information for public health activities to a public health authority authorized by law to collect or receive information for the purpose of controlling disease, injury or disability. We may also disclose your health information to a public authority authorized to receive reports of child abuse or neglect or to report information about products or services under the jurisdiction of the United States Food and Drug Administration. Additionally, we may disclose your health information to a person who may have been exposed to a communicable disease or otherwise be at risk of contacting or spreading a disease and to your employer for certain work-related illness or injuries. 
  5. Health Oversight Activities. We may make disclosures of your personal health information to a health oversight agency charged with overseeing the health care industry. Disclosures will be made only for activities authorized by law. 
  6. Judicial and Administrative Proceedings. We may disclose your personal health information in the course of any judicial or administrative hearing in response to an order of a court or administrative tribunal, or in response to a subpoena, discovery request or other lawful process where we receive satisfactory assurance that appropriate precautions have been taken. In all cases, we will take reasonable steps to protect the confidentiality of your health information.
  7. Law Enforcement. We may disclose your personal health information for a law enforcement purpose to law enforcement officials in compliance with and as limited by applicable law.
  8. Fund-raising. We may contact you for certain fundraising activities related to our organization. In all such cases, we will obtain your written authorization prior to sending any information to you.
  9. Marketing. For marketing activities, we will obtain your written authorization prior to sending any information to you, unless we are not required by law to do so. 
  10. Research. We may use or disclose your personal health information without your authorization for research purposes when such research has been approved by an institutional review board that has reviewed the research to ensure the privacy of your personal health information, or as otherwise allowed by law.
  11. Victims of Abuse, Neglect or Domestic Violence. We may disclose personal health information about an individual whom we reasonably believe to be a victim of abuse, neglect or domestic violence to a government authority, including a social service or protective service agency authorized by law to receive reports of child abuse, neglect or domestic violence. Any such disclosures will be made in accordance with and limited to the requirements of the law.
  12. Limited Government Functions. We may disclose your personal health information to certain government agencies charged with special government functions, as limited by applicable law. For example, we may disclose your health information to authorized federal officials for the conduct of national security activities, as required by law.
  13. Organ Procurement. As allowed by law, we may disclose personal health information to organ procurement organizations for organ, eye or tissue donation purposes.
  14. Coroners, Medical Examiners and Funeral Directors. We may disclose personal health information to a coroner or medical examiner to identify a deceased person, determine a cause of death or for other duties as authorized by law. We may also disclose personal health information to funeral directors in accordance with applicable laws.
  15. Health and Safety. We may disclose your personal health information to prevent or lessen a serious threat to a person or the public health and safety. In all cases, disclosures will only be made in accordance with applicable law and standards of ethical conduct.
  16. Workers Compensation. We may disclose your personal health information in accordance with workers compensation laws.

Your Rights. You have the right to do the following:

  1. Right to Receive a Copy of this Notice. Upon request, you have the right to receive a paper copy of this Notice. We will provide a copy if you request it at our offices.
  2. Right to Receive Further Information. You have the right to contact our Privacy Officer at 1117 Country Hills Drive, #8A, Ogden, UT 84403 if you want additional information about our privacy practices, your privacy rights, or disagree about a decision we made about your personal health information, or if you believe that your privacy rights have been violated. The Privacy Officer will provide you with the information you need to file a complaint.
  3. Right to Inspect and Copy Your Health Information. Upon written request, you have the right to access and obtain a copy of your health information maintained by us. Please contact our Privacy Officer at 1117 Country Hills Drive, #8A, Ogden, UT 84403 for information you need to access and copy your protected health information.
  4. Right to Amend Your Health Information. You have the right to request in writing that we amend health information maintained in your health record. We will comply with your request in the event that we determine the information that would be amended is false, inaccurate or misleading.   5. Right to Request Additional Restrictions on Uses and Disclosures of Your Health Information. You have the right to request in writing that we place additional restrictions on how we use or disclose your personal health information. While we will consider any request for additional restrictions, we are not required to agree to your request.   6. Right to Request an Accounting of Disclosures. You have a right to request in writing an accounting of certain disclosures made by us of your personal health information. For each disclosure, the accounting will include the date the information was disclosed, to whom, the address of the person or entity that received the disclosure (if known), and a brief statement of the reason for the disclosure.   7. Right to Request Confidentiality in Certain Communications. You have the right to request to receive your health information by alternative means of communication or at alternative locations. We will accommodate any such reasonable written request made on your behalf. If you believe your privacy rights have been violated, in addition to filing a complaint with us, you have the right to file a written complaint with the Office of Civil Rights of the United States Department of Health and Human Services. Upon request, the Privacy Officer will provide you with the information needed to file your complaint. Under no circumstances will we retaliate against you for filing a complaint with us or the Office of Civil Rights.

Changes to Notice. We reserve the right to change our privacy practices and to alter this Notice according to those changes. In the event that our Notice changes, we will mail you a copy of our revised notice to the address you have supplied us.

Registration

In order to use Counseling on this website, a user must first complete a registration form.  During registration a user is required to give extensive information (such as name, address, medical history, social history, unique identifiers like social security number, and email address).  This information is used for diagnostic and counseling processes, for which users have expressed interest.  This allows us to provide a more personalized experience on our site, and for legal purposes gives our counselors sufficient information to adequately interact with the user.  Counseling services require full disclosure of usual information required of clients by a professional counselor.

 
Order

We request information from the user on our order form.  Here a user must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date).  This information is used for billing purposes and to fill customer’s orders.  If we have trouble processing an order, this contact information is used to get in touch with the user.


Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user.  Usage of a cookie is in no way linked to any personally identifiable information while on our site.  Once the user closes their browser, the cookie simply terminates.  For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site.  If a user rejects the cookie, they may still use our site.  The only drawback to this is that the user will be limited in some areas of our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site.

Some of our business partners use cookies on our site (for example, advertisers).  However, we have no access to or control over these cookies.


Log Files

We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use.  IP addresses are not linked to personally identifiable information.


Sharing

We will share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.

We may use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

We may partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services.

These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

This web site contains links to other sites. Please be aware that we, Axis-One, Inc., are not responsible for the privacy practices of such other sites.  We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information.  This privacy statement applies solely to information collected by this Web site.


Newsletter

If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address.


Surveys

From time-to-time our site requests information from users via surveys.  Participation in these surveys is completely voluntary and the user therefore has a choice whether or not to disclose this information.  Information requested may include contact information (such as name and email address), and demographic information (such as zip code, age level).  Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.

Recommendations

If a user elects to use our referral service for informing a friend about our site, we ask them for the friend’s name and email address.  Axis-One, Inc.
will automatically send the friend a one-time email inviting them to visit the site.  Axis-One, Inc. stores this information for the sole purpose of sending this one-time email.  The friend may contact us to request the removal of this information from their database.

Forums

Disclosing personally identifiable information online through Chat Rooms, Forums, and Message Boards makes the information submitted public information; such disclosure may increase a user's chance of receiving “spam” or unsolicited email, or even personal contact.  Users are warned to be extra careful and to use their discretion when disclosing information online in such media.  Users of such media for Counseling at
Axis-One.Com will have their messages encrypted over a secure server.

Supplementation of Information

In order for this website to properly fulfill its obligation to our customers, it is necessary for us to supplement the information we receive with information from 3rd party sources.

For example, it may be necessary to obtain medical information and/or insurance information to determine appropriate diagnosis and/or to file claims.  Only information necessary to complete an ongoing file, or to satisfy legal requirements, is kept longer than one year past the time of our sessions.

Special Offers

We send all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see our choice and opt-out below.

 
Site and Service Updates

We also send the user site and service announcement updates. Members are not able to un-subscribe from service announcements, which contain important information about the service. We communicate with the user to provide requested services and in regards to issues relating to their account via email or phone.


Security

Correction/Updating Personal Information:

If a user’s personally identifiable information changes (such as your zip code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user’s personal data provided to us.  This can usually be done at
information@axis-one.com.  If for some reason this does not work, notify Emory@axis-one.com.


Choice/Opt-out

Our users are given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to our site at the point where we ask for the information.  For example, our order form has an ‘opt-out’ mechanism so users who buy a product from us, but don’t want any marketing material, can keep their email address off of our lists. 

Users who no longer wish to receive our newsletter or promotional materials from our partners may opt-out of receiving these communications by replying to unsubscribe in the subject line in the email or email us at information@axis-one.com.

Users of our site are always notified when their information is being collected by any outside parties.  We do this so our users can make an informed choice as to whether they should proceed with services that require an outside party, or not.


Notification of Changes

If we decide to change our privacy policy, we will post those changes on our Home page, under the top tab Our Commitment, then under the side tab Privacy, so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it.  If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email.  Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
